The Troup County Board of Commissioners has as soon as yet again postponed a final decision to allow for a home business for a truck driver who was caught parking his tractor truck at his dwelling.

Through the earlier commissioner’s assembly on Dec. 20, the board thought of a request from Spence Jester to operate a trucking organization out of his residence positioned at 132 East Mount Zion Church Rd. The household would only be utilized to have out the telecommunications, preparing and coordination for the trucking company.

Beneath county ordinance, tractor vans about 11,000 lbs ., like the 18,000-pound truck operated by the applicant, are not allowed to be parked at residences with out entire enclosure.

Group Improvement Director Troy Anderson suggested that the applicant experienced agreed to store the truck at an offsite facility.

Anderson recommended that team was geared up to recommend acceptance of the property organization, having said that, it was learned that Jester had parked his truck in the entrance yard of the household in violation of county ordinance, so employees encouraged denial.

Through the preliminary community hearing, the applicant insisted that he experienced not “parked” the tractor truck at the house, indicating that he had merely “stopped” there right away. Jester indicated that he parked the trailer in Newnan in a room that he experienced paid out for and only brought the truck residence.

At the time, Jester created no indicator that he planned to cease parking at the home.

Jester isn’t on your own in parking his tractor truck at his residence. Anderson said that vans are commonly parked at residences throughout the county in violation of the ordinance.

Anderson stated no complaints had been received about the applicant parking his truck at the home, but at the very least a single connect with was received about a very similar truck parked at an additional home.

Commissioner Morris Jones suggested putting ailments that would let the applicant to park his truck at the house so that he can keep on earning a dwelling. Commissioner Lewis Davis echoed these ideas saying that the unincorporated spot of Troup County must be regarded in another way.

“When you live in the unincorporated location, I feel you really should reside on a small various rule than if you stay in downtown LaGrange,” Davis said. “I do not want to be the sort of man or woman that hurts a male trying to make a living, but I also believe that the person ought to dwell less than specific disorders to continue to keep it in an orderly method.”

“I imagine we will need to sit back and seriously search at this prior to we go ahead in my view. We need to appear and see, [since] the neighbor is not complaining, if the county can occur in with some style of problems for this specific on what he’s obtained to do. Then the next circumstance it comes up, you previously set a priority on what you do,” Jones stated.

County Lawyer Jerry Willis reminded the commissioners that parking the truck at the property is a violation of county ordinance, not just a condition for the small business application.

“I do not know how you can set a situation on a tractor, possibly parking there or not parking there, for the reason that your ordinance says you just can’t do it,” Willis said.

Willis advised that the commissioners could transform the ordinance but making it possible for the applicant to park there beneath a condition would be inappropriate.

Quite a few commissioners pushed back on the parking rule declaring it should be regarded on a case-by-circumstance basis.

“That specific rule is far too stringent. You are seeking to implement the procedures, and I recognize,” Davis mentioned. “It’s just my personalized impression. I feel it is a little as well normal, the place it’s just make a difference of simple fact, certainly or no, black or white.”

Ultimately, the commissioners voted to continue on the discussion on the software until eventually the upcoming meeting to get more facts from the applicant and to allow county employees to see how other counties offer with the situation.
